Terms of Service

1. Acceptance and scope

These terms govern nimboweb services: website builds, monthly management, digital presence reports, and professional domain email. By hiring any of these services, you accept these terms.

The exact scope of each plan is published at nimboweb.com/en/pricing/ and confirmed in writing in each quote. What is not in the scope is not included.

2. Services

Builds (one-time payment): Nimbo Landing, Nimbo Esencial, Nimbo Profesional, and Nimbo GEO, with the published scope for each tier.

Monthly plans: Base, Crecimiento, GEO Diagnostic, and standalone email, with the published scope. Base and Crecimiento plans include the contact form service (hosted at form.nimboweb.com). Annual payment equals 10 months for 12.

Distinction between "Full report" and "GEO Diagnostic". The GEO Diagnostic (nimboweb.com/en/diagnostic/) is available for ANY website and platform, with no migration or proxy required: its scope is the citation panel on 5 AI surfaces + your Google numbers via Search Console, plus AI readership only if your site can go through Cloudflare. The Full report (traffic, conversions and detailed AI readership) is available only for sites whose provider allows connecting the measurement (proxy): cPanel/VPS/self-hosted WordPress, Shopify, Webflow, WordPress.com and Squarespace, plus sites built by nimboweb. On Wix, Google Sites, Blogger, Tiendanube and similar platforms, the full report is not available; the GEO Diagnostic is. If your site is on one of those platforms and you want the full report, rebuilding it with nimboweb includes the full report in the monthly plans. The full report depends on the client keeping nimboweb’s collaborator access to their web provider and Google Search Console; if that access is revoked, the report stops at the end of the paid period.

3. Quotes and payments

All prices on this English site are in US dollars (USD) and include no VAT. The Spanish site (nimboweb.com/precios/) shows prices in Chilean pesos (CLP). Builds are paid 100% upfront; work begins with confirmed payment. Monthly and annual plans are paid in advance.

As an exception, nimboweb may discretionally offer a 50/50 scheme to close a sale; in that case, the source code and final deploy are delivered only after the second payment.

4. Refunds (builds)

Work not started: 100% refund. Work started: 50% refund. After first preview delivery: no refund. Monthly plans are not refundable for the period already elapsed.

The right of withdrawal under Chilean Law 19.496 (10 days from purchase in distance sales) is compatible with this policy: within the first 10 days, if work has not started, the refund is 100% without needing to invoke the withdrawal right. If work already started within those 10 days, the 50% refund under the previous policy applies.

5. Client obligations

To deliver the site content (texts, photographs, logo, contact details) declaring to have the rights to use it. nimboweb is not responsible for client-provided content that infringes third-party rights.

Included revisions are those of each tier (1 round in Nimbo Landing, 2 in the rest). Additional rounds are quoted as an additional service at the published fixed price.

6. Ownership: domain and code

The domain is always registered in the client’s name. The site’s source code belongs to the client once the build payment is completed.

No strings attached: if the client cancels, they receive the source code (or the compiled site ready for any hosting), an export of their DNS records, and migration of their mailboxes. The monthly report and the contact form (service hosted at form.nimboweb.com) stop at the end of the paid period. The client can replace the form with any provider by changing one line of code — there is no technical lock-in, only a service dependency.

7. Monthly plans

They include up to 2 small changes per month (maximum 30 minutes each: texts, photos, prices, links). Unused changes do not accumulate. Anything beyond that definition is quoted as an additional service.

Cancellation can be requested at any time with 15 days notice. No minimum term, no penalties.

8. What is not included

nimboweb services do NOT include: online stores, custom web applications, maintenance of third-party WordPress/Wix sites, logo design, photography, social media management, or paid advertising. I also do not guarantee specific Google positions or commercial results: I deliver technical best practices and the data to decide, not ranking promises.

9. Limitation of liability

The service is delivered to professional standards, but nimboweb is not liable for third-party outages (Cloudflare, Resend, Migadu, NIC Chile) or for decisions made by search engine or AI algorithms. In any case, maximum liability is limited to the amount actually paid by the client in the last 3 months.

10. Governing law and jurisdiction

These terms are governed by the laws of Chile. Any dispute will be submitted to the competent courts of Chile. If any clause is declared invalid, the remaining terms stay in effect.
